The responsibility of the French State in the deportation reaffirmed

The State Council, the highest French administrative court, said Monday that the "responsibility" of the French government was involved in the deportation of Jews under the Vichy regime, while closing the door to compensation.

  •     This is the first time the Council of the State declared so solemn the responsibility of the French State in the deportation of Jews, even if he had already established the principle, according to a spokesman. Its opinion will be published in the Official Journal.

        In 1995, the former French President Jacques Chirac was the first who recognized on behalf of France, the State's responsibility in the deportation of Jews under the Vichy regime, who collaborated with the Germans during the Second World War.

        The highest administrative court found that this "responsibility" of the State was "committed because of the damage caused by the acts which, not resulting from direct coercion of the occupier, enabled or facilitated the deportation from France of victims of anti-Semitic persecution."

        The Council cites examples "arrests, internment and conveys to the transit camps, which were, during the Second World War, the first step in the deportation of people to camps where most of them were exterminated."

        However, the State Council, which had been seized on a particular case, the one of the daughter of a deportee, was not wide open the way towards meeting the many requests for compensation.

        On the contrary, he felt that even if he had adopted since the post-war "a very gradual approach", the State had taken steps to compensation "must be regarded to have allowed, provided it was possible compensation for damage of any kind."

        These claims were taken "with the rights guaranteed under the European Convention on Human Rights and Fundamental Freedoms". They are "comparable" to those taken by other European states in the same situation, said the State Council.
